Child Support

West Virginia Child Support Attorney

Even when they are no longer married, both parents are obligated to support their children. In West Virginia, there are state guidelines that calculate how much child support you will be expected to pay or that you can receive after a divorce. These guidelines are based on the incomes of both parents.

Both parents are expected to support their children

At my Charleston, West Virginia, law office, I make sure that all aspects of a client's financial picture is included in any support calculation derived from using the support guidelines. This includes gross income, child support already being paid for other children, alimony being paid to another former spouse, extraordinary expenses (such as those for a special needs child) and day care costs.

Making sure support orders are fairly calculated and in the best interests of the child

Modification of child support orders

I assist clients with modifying an initial child support order. Modifications are allowed when the circumstances of either parent change significantly. Such changes can include job loss or temporary layoff, illness, remarriage or relocating from West Virginia.

Act immediately if you are unable to make your child support payments

If you are the payor of child support, it is important to seek a modification of an order immediately. If you simply fail to pay required child support, whatever the reason, you will be found in arrears. Even if you eventually obtain a modification of the amount, you will be responsible for the arrearage from the time you ceased paying until the modification was issued. If the arrearage grows to over $10,000, you can be classified as a felon and will be unable to possess a firearm under West Virginia law.

How I can help you

I appear at hearings for clients who are seeking a modification of a support order, are defending against the modification, or hope to begin enforcement proceedings. I answer questions about the documentation required to verify income. In everything I do, I try to minimize client costs in disputes over child support; the more spent on litigating disputes, the less money there will be for you and your children.

If you have a question about child support calculations, if you want to modify an existing order, or seek to defend against a modification petition, contact my Charleston law office, Shawn Taylor, PLLC to schedule a confidential consultation. Call 304-345-5959.
