Serviceman's Civil Relief Act

The Serviceman's Civil Relief Act of 2003 formerly known as the Soldiers and Sailors Act, gives military personnel special rights. Active duty members are allowed to postpone some legal obligations, such as the need to respond to divorce papers. When a court determines that a respondent is subject to the provisions of the act, it will defer the proceedings. If someone serves papers on a member of the military and does not indicate that he or she is subject to the law, any legal determinations are not binding.

Talk with your commanding officer if you are served with divorce papers while on active military duty
